Legalna korupcja metodą zapewniania korzyści majątkowych i osobistych

Abstract

The article presents analyzes and considerations devoted to discussing the conditions, activities and mechanisms that are characteristic for the so-called legal corruption that occurs in daily management practice. At the beginning, the essence of the legal corruption concept was explained, paying special attention to the instrumental use of power to guarantee above-average material and personal benefits for a selected group of favoured persons. Mechanisms and actions specific to legal corruption were presented in a systemic approach. The next part of the paper describes the network of inter-organizational dependencies and relationships as element of a corrupt system. Based on the conducted analytical work, a network of connections between political parties and economic institutions and entities was shown, and factors influencing the nature of mutual relations between individual organizations were analyzed. Then the illusory of the so-called separation of powers was commented and the principle of citizens equality before the law, as well as equal treatment by public authorities, referring to provisions of the Constitution of the Republic of Poland and examples from practice were discussed in detail. The summary highlights the fact that corruption is a threat to internal security, and that secret services play an important role in pursuing state interests.
