Wybrane prawne aspekty kradzieży tożsamości w cyberprzestrzeni

Abstract

The aim of the article is to present the basic concepts of impersonation crimes, often referred colloquially as identity theft. A brief analysis of the provisions of the penal code referring to this crime is the starting point for the analysis of the case law of common courts and the Supreme Court. On this basis, conclusions will be raised regarding the problems that the practice of applying the aforementioned provisions brings, as well as postulates regarding both the directions of interpretation of the applicable law and its changes.
